This limited warranty is provided by RAB Design Lighting Inc. (“Seller”) to you as the original purchaser of the LED lighting product that is identified on Seller’s invoice reflecting its original purchase (the “Product”). This limited warranty may be transferred to subsequent purchasers of the Product, provided that such Product is resold in new condition and in its original packaging. Seller warrants that the Product, when delivered in new condition and in its original packaging, will be free of defects in material and workmanship for a period of FIVE (5) YEARS from the date of original purchase. The determination of whether the Product is defective shall be made by Seller in its sole discretion with consideration given to the overall performance of the Product. A Product shall not be considered defective solely as a result of the failure of individual LED components to emit light if the number of inoperable components is less than 10% of the total number of LED components in the Product.

If Seller determines the Product is defective, Seller will elect, in its sole discretion, to refund you the replacement value of the Product, repair the Product or replace the Product. Seller may potentially contribute to the cost of an electrician, including the cost of required rental equipment, related to the repair or replacement of a defective product subject to Seller’s sole discretion. This limited warranty will not apply to loss or damage to the Product caused by: negligence; abuse; misuse; mishandling; improper installation, storage or maintenance; damage due to fire or acts of God; vandalism; civil disturbances; power surges; improper power supply; electrical current fluctuations; corrosive environment installations; induced vibration; harmonic oscillation or resonance associated with movement of air currents around the Product; alteration; accident; failure to follow installation, operating, maintenance or environmental instructions prescribed by Seller or applicable electrical codes; or improper service of the Product performed by someone other than Seller or its authorized service provider. THIS LIMITED WARRANTY IS VOID IF THE PRODUCT IS NOT USED FOR THE PURPOSE FOR WHICH IT IS DESIGNED.

Seller reserves the right to utilize new, reconditioned, refurbished, repaired or remanufactured products or parts in the warranty repair or replacement process. Such products and parts will be comparable in function and performance to an original product or part, as determined by Seller in its sole discretion, and warranted for the remainder of the original warranty period.

In order to make a warranty claim, you must notify Seller in writing within sixty (60) days after your discovery of the defect, provide proof of purchase such as the invoice and comply with Seller’s other warranty requirements. Upon receiving that notice, Seller may require you to promptly return the Product to Seller, or its authorized service provider, freight prepaid. This limited warranty applies to all RAB Design LED fixtures, with the exception of the LED Inspection Light and the battery powered MPL, all of which have a THREE (3) YEAR limited warranty

THE FOREGOING WARRANTY PROVISIONS ARE EXCLUSIVE AND ARE GIVEN AND ACCEPTED IN LIEU OF ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY AGAINST INFRINGEMENT AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL SELLER BE LIABLE FOR INCIDENTAL, COMPENSATORY, CONSEQUENTIAL, INDIRECT, SPECIAL OR OTHER DAMAGES.

This warranty is effective for purchases of Product on or after the effective date set forth below. Seller reserves the right to modify this warranty from time to time. Any modification of this warranty shall be effective for all orders placed with Seller on or after the effective date of such revised warranty.

La présente garantie limitée vous est offerte par RAB Design Lighting inc. (le « vendeur ») parce que vous êtes l’acheteur du luminaire DEL indiqué sur la facture remise par le vendeur lors de l’achat d’origine (le « produit »). Elle peut être transférée aux acheteurs ultérieurs du produit à condition que ce dernier soit revendu à l’état neuf et dans son emballage d’origine. Le vendeur garantit que le produit, lorsqu’il est livré à l’état neuf et dans son emballage d’origine, est exempt de tout défaut de matériau et de fabrication pendant une période de CINQ (5) ANS à compter de la date d’achat initiale. Le vendeur déterminera si le produit est défectueux à sa seule discrétion d’après le fonctionnement global du produit. Un produit ne sera pas considéré comme défectueux du seul fait que certains composants DEL n’émettent pas de lumière si le nombre de composants non fonctionnels compte pour moins de 10 % du nombre total de composants DEL dans le produit.

Si le vendeur détermine que le produit est défectueux, il choisira, à sa seule discrétion, de vous rembourser la valeur de remplacement du produit ou de réparer ou de remplacer le produit. Le vendeur pourrait à sa seule discrétion contribuer à payer le travail d’un électricien, y compris le coût de l’équipement à louer pour faire ce travail, pour la réparation ou le remplacement d’un produit défectueux. La garantie limitée ne s’applique pas aux pertes ou dommages causés au produit par la négligence; les abus; la mauvaise utilisation; la mauvaise manipulation; l’installation, l’entreposage ou l’entretien déficients; les dommages causés par le feu ou les catastrophes naturelles; le vandalisme; les troubles civils; les surtensions; l’alimentation électrique inadéquate; les fluctuations du courant électrique; l’installation dans un environnement corrosif; les vibrations induites; l’oscillation harmonique ou la résonance associée au mouvement des courants d’air autour du produit; l’altération; un accident; le non-respect des instructions d’installation, d’utilisation ou d’entretien ou des consignes environnementales prescrites par le vendeur ou les codes d’électricité applicables ou l’entretien inadéquat du produit par quelqu’un d’autre que le vendeur ou son fournisseur de services autorisé. LA GARANTIE LIMITÉE DEVIENT NULLE ET CADUQUE SI LE PRODUIT N’EST PAS UTILISÉ AUX FINS POUR LESQUELLES IL A ÉTÉ CONÇU.

Le vendeur se réserve le droit d’utiliser des pièces ou des produits neufs, reconditionnés, remis à neuf, réparés ou refabriqués pour une réparation ou un remplacement sous garantie. Ces pièces ou produits auront un fonctionnement et une efficacité jugés comparables par le vendeur à sa seule discrétion et seront garantis pour le reste de la période de garantie d’origine.

Vous devez informer le vendeur de toute intention de faire une réclamation de garantie par écrit dans les soixante (60) jours suivant la découverte du défaut, fournir une preuve d’achat (la facture, par exemple) et vous conformer aux autres exigences de la garantie du vendeur. Dès réception de l’information, le vendeur peut exiger que vous lui retourniez rapidement le produit ou que vous le retourniez à son fournisseur de services autorisé en port payé. La garantie limitée s’applique à tous les luminaires DEL de RAB Design, à l’exception de la lampe d’inspection DEL et de la lampe multifonction à batterie, qui bénéficient dans leur cas d’une garantie limitée de TROIS (3) ANS.

LES DISPOSITIONS PRÉCÉDENTES DE LA GARANTIE SONT EXCLUSIVES ET SONT DONNÉES ET ACCEPTÉES EN LIEU ET PLACE DE TOUTE AUTRE GARANTIE, EXPRESSE OU IMPLICITE, Y COMPRIS TOUTE GARANTIE CONTRE LA CONTREFAÇON ET TOUTE GARANTIE IMPLICITE DE QUALITÉ MARCHANDE OU D’ADÉQUATION À UN USAGE PARTICULIER.

LE VENDEUR NE PEUT EN AUCUN CAS ÊTRE TENU DE VERSER DES DOMMAGES-INTÉRÊTS ACCESSOIRES, COMPENSATOIRES, CONSÉCUTIFS, INDIRECTS, PARTICULIERS OU AUTRES.

La garantie s’applique aux achats de produits effectués à partir de la date indiquée ci-dessous. Le vendeur se réserve le droit de modifier cette garantie de temps à autre. Toute modification de la garantie s’applique à toutes les commandes passées auprès du vendeur à compter de la date d’entrée en vigueur de la garantie révisée.
